Client Waiver & Release of Liability 

Formé Mat Pilates + Sculpt Operated by Wiggs Family Enterprise LLC

Effective Date: November 5, 2025 

1. Acknowledgment of Risk 

I understand that participation in any Pilates, fitness, or wellness activities at Formé Mat Pilates + Sculpt (“the Studio”) involves inherent risks, including but not limited to physical exertion, muscle strain, dehydration, falls, slips, or injury. I voluntarily choose to participate, fully aware of the possible risks involved. 

2. Heated Room Disclosure 

I acknowledge that certain classes are conducted in a heated environment, which may elevate heart rate, body temperature, and physical exertion. I understand that: 

  • The heated environment may not be suitable for all individuals. 

  • It is my responsibility to consult a physician before participating. 

  • I will monitor my condition during class and stop immediately if I feel dizzy, faint, overheated, or unwell. 

  • The Studio is not responsible for providing or covering any medical treatment, emergency care, or assistance in the event of injury or illness. 

3. Assumption of Responsibility 

I accept full responsibility for my physical condition, health, and ability to participate safely. I will inform the instructor of any pre-existing injuries or medical conditions that could affect participation. I release the Studio from any obligation to assess my fitness or limitations. 

4. Release and Waiver of Liability 

In consideration of being allowed to participate in Studio activities, I voluntarily release, waive, and discharge Formé Mat Pilates + Sculpt, Wiggs Family Enterprise LLC, its owners, instructors, employees, contractors, and representatives from any and all claims, demands, or causes of action arising out of or related to: 

  • Participation in classes, programs, or events. 

  • The use of Studio facilities, restrooms, dressing areas, showers, or common spaces. - Any falls, slips, or injuries sustained on the premises.

  • Any slips caused by water, sweat, or any other liquid — the Studio is not responsible in any rooms, establishments, restrooms, or any part of our premises. 

  • Any medical incidents arising from participation in heated or non-heated classes. - Any lost, damaged, or stolen personal items on the premises. 

This release applies to all forms of injury, illness, loss, or damage, including those caused by negligence, omission, or the condition of the facilities or equipment. 

5. Indemnification 

I agree to indemnify and hold harmless the Studio and its representatives from any claims, liabilities, damages, or expenses (including legal fees) arising from my actions or participation in Studio activities. 

6. Use of Likeness 

I grant the Studio permission to use photos or videos taken during classes or events for marketing or promotional purposes, without compensation. I may opt out by providing written notice. 

7. Acknowledgment and Understanding 

I have read and fully understand this waiver and release. I voluntarily agree to its terms, and I understand that by signing below, I am waiving certain legal rights.
