1. Acceptance of Terms 

By accessing or using the services of Formé Mat Pilates + Sculpt (“Studio,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree, you may not access or use our services. 

2. Services 

We provide group and private mat Pilates, sculpt, and related fitness sessions available for booking via our website and the Mariana Tek platform. All services are subject to instructor availability and scheduling. 

3. Memberships, Class Packs, and Drop-ins 

- Membership, class pack, and drop-in pricing is listed on our booking platform. - Memberships are personal and non-transferable. 

- Class credits and packages expire as stated at purchase. 

4. Booking, Cancellations, and Late Policies 

- Members: may cancel a class up to 12 hours before the scheduled start time without penalty. - Non-members: may cancel a class up to 24 hours before the scheduled start time without penalty. - Late Cancellation: cancellations made after the policy window incur a $14 late fee. - No-show: failure to attend a reserved class without canceling results in a $20 fee. - Repeated no-shows or late cancellations may result in temporary suspension of booking privileges. 

5. Payments 

All payments are processed securely via the Mariana Tek platform. By purchasing services, you authorize the Studio to charge your provided payment method for applicable fees, including recurring membership dues, no-show fees, and late cancellations.

6. Refunds and Transfers 

All sales are final. Refunds or credit transfers are not provided except where required by law or at the Studio’s sole discretion. 

7. Assumption of Risk and Waiver of Liability 

By participating in classes or using our facilities, you acknowledge that physical exercise involves inherent risks, including injury or illness. You voluntarily assume all risks and agree that the Studio, its owners, instructors, and employees are not liable for any injury, loss, or damage arising from participation. Participants must disclose any relevant medical conditions to the instructor prior to class. 

8. Conduct 

Clients are expected to maintain respectful behavior toward instructors and other clients. The Studio reserves the right to refuse service or terminate memberships for disruptive, unsafe, or inappropriate conduct. 

9. Personal Belongings 

We are not responsible for lost, stolen, or damaged personal property on the premises. 

10. Intellectual Property 

All content, logos, photography, and materials on the Studio’s website and marketing materials are owned by Wiggs Family Enterprise LLC and may not be copied or used without written consent. 

11. Changes to Terms 

We reserve the right to modify these Terms at any time. Updated terms will be posted on our website, and continued use constitutes acceptance. 

12. Governing Law 

These Terms are governed by and construed under the laws of the State of Texas. Any disputes will be resolved in Dallas County, Texas.
